Under the leadership of former chairman Gary Gensler, the SEC intensified its scrutiny of the crypto market, including efforts that led to the conviction of former FTX CEO Sam Bankman-Fried. The Biden administration’s approach aimed to enforce compliance with regulations that govern Wall Street firms, but crypto advocates argue that the emerging financial products require a distinct regulatory framework—one that critics allege is being shaped to benefit the industry through substantial electoral contributions. “Consumers might find themselves in a precarious situation, facing a myriad of new products with diminished oversight and increased risk,” warns Mark Hays, associate director for cryptocurrency and financial technology at Americans for Financial Reform. “We’re conducting an uncontrolled experiment on our financial system with technology that has yet to fulfill its promises.” Nevertheless, buoyed by the recent success of the GENIUS Act, the crypto industry continues to advance its agenda.
